Terms and Conditions for purchases of digital gift cards

General

These terms and conditions (the "Terms and Conditions") applies to purchases of digital gift cards (the “Digital Products”) that you, as a consumer, purchase from Star Stable Entertainment AB (“SSE”/”we”/”us”), on SSE’s website, shop.starstable.com (the "Shop"/ “Website”).


Conditions for purchase

In order to make a purchase in the Shop, you guarantee that:

·       you make the purchase as a consumer (not representing a company),

·       you are 18 years old or older or your parent has approved the purchase,

·       you have the right to enter into binding agreements,

·       you use the Shop in accordance with these Terms and Conditions, and

·       that any and all information you provide in the Shop is true, correct, actual and complete.

Place your order at the Shop

The Terms and Conditions applicable for your order is the ones available at the Website at the time you place your order in the Shop. By placing an order, you agree to comply with these Terms and Conditions. You are responsible for providing the correct information, such as your email address, when purchasing a Digital Product. We will not replace incorrect deliveries or similar, if you have provided incorrect information. SSE is bound to carry out your order only when you have received an order confirmation of your purchase.

After you have ordered your Digital Product, we will send you an order confirmation of your purchase, including the Digital Product, to the email address you have provided. The order confirmation will also include information on how the Digital Product may be used/redeemed. We recommend that you save or print the order confirmation and these Terms and Conditions on your computer. If we for any reason are unable to send your order, we will notify you as soon as possible.

Information about the Digital Products

The details of the Digital Product characteristics can be found in the Digital Product description for each Digital Product in the Shop. The Digital Product description will also be included in the order confirmation. The requirements of use will also be stated in the Digital Product description but please note that the Digital Product may only be used/redeemed on Star Stable Online] meaning that you or any other recipient will need (i) internet access, (ii) to be a registered user of SSO and (iii) to be logged in on your account in order to used/redeem the Digital Product. Further, the Digital Product is not linked to a specific person, why you should handle it with care. We are not responsible for any lost Digital Product.

Any Digital Product purchased must be used within 3 years from the date of purchase. After such date, the Digital Product becomes invalid and cannot be used.

Any Digital Product purchased can only be used on one occasion. The full value will be deducted upon redemption. As such, it is not possible to redeem only part of the value or to receive part of the value.

 

Prices

The prices for the Digital Products are stated in the Shop. All prices and fees are stated in USD include, unless otherwise expressly stated, value added tax.

We are not bound by an order if you have realized or should have realized that the price quoted is too low, and we may cancel orders as a result. Likewise, SSE makes reservations for any price changes that occur before you complete your order. Please note that we reserve the right to send a payment request to your email address.

You may use the following payment methods:

Adyen

Payment is made at the time of purchase with Adyen. Through Adyen, you can choose between various payment methods.

Third party service providers

All payments are handled via the aforementioned third-party service providers. SSE does not control such websites, services and/or products and is not responsible for content therein or your use of them. We undertake no responsibility for services provided on these websites. Special conditions apply to such services. We encourage you to read such terms carefully as they constitute an agreement between you and the third party. Read the terms here: www.adyen.com. Any information that you provide on such website is provided to the relevant operator of such website and not to us.

Transfer payment claims

We reserve the right to transfer or pledge payment claims to third parties, including instalments incurred in connection with the delivery of the Digital Products.

 


Delivery

We strive to deliver Digital Products as soon as possible. Your Digital Product is created digitally and delivered digitally to your email.

 


Right of withdrawal

Your right of withdrawal is regulated in the Swedish Distance and Off-Premises Contracts Act and generally means that if you have purchased a Digital Product from the Shop, you have a 14-day right to withdraw from the purchase without giving any reason. The withdrawal period will expire 14 calendar days from the day that you received the Digital Product, however provided that the Digital Product is unredeemed. If the Digital Product has been used/redeemed, you will no longer have a right of withdrawal. To exercise your right of withdrawal, you must inform us (please refer to customer support information below) of your decision to withdraw from the purchase by an unequivocal statement before the expiry of a 14-day withdrawal period. You may use this form  to exercise your right of withdrawal.

Consequences of exercising your right of withdrawal

If you withdraw from the purchase made directly through on the Website in accordance with the aforementioned requirements, we will reimburse to you all payments received from you under the purchase without undue delay and in any event not later than 14 calendar days from the day on which we receive your decision to withdrawal.

The refund will be made with the same payment method that you used to make the purchase, unless the parties have agreed otherwise.


Intellectual property rights

The Shop is owned exclusively by, and with unlimited right of disposal of, SSE.

The intellectual property rights, such as trademarks, design rights and copyrights on the Website vest in SSE and/or it’s collaboration partners and may not be used for commercial purposes without obtaining prior written consent from SSE. All use of the site and its content, including copying or storing such content, regardless of if it is the content in whole or in part, is prohibited without obtaining prior written consent from SSE, except if the use is for your own personal, non-commercial use.

Nothing in these Terms and Conditions shall be construed as a transfer or sublicense of any intellectual property rights or other rights to the Shop and/or content on the Shop.


Complaints

If you want to make a complaint of a Digital Product purchased from us or have received a defective or wrong Digital Product and would like to make a claim, we recommend you contact our customer service via support form. You may also reach via the contact details to our customer support below. Please enter your name and address as well as your order number when contacting us and describe why you want to make a claim regarding the Digital Product.

Claims must always be submitted within a reasonable time from the time you discovered or should have discovered that the Digital Product you purchased from SSE does not meet your expectations. If a claim is not made in time, you lose your right to make a claim. As a consumer, you are always considered to have submitted your claim in time if the message is submitted within 2 months after you notice the defect and you have a right to make a claim for 3 years from when you received the Digital Product.

If the claim was made in time and there is a basis for the claim, SSE will inform you if and how the Digital Product will be remedied or if you will get a redelivery of the Digital Product or if you will receive a price reduction on the defective Digital Product.


Force majeure

Neither you nor SSE is responsible for deficiencies in the performance of these Terms and Conditions if the deficiency is due to a circumstance beyond a party's control ("force majeure"). Such force majeure can e.g. be the action or omission of an authority, new or amended legislation, conflict on the labor market, blockade, fire, natural disaster, pandemic, major accident, war or terrorist attack, technical problem or other circumstance that significantly hinders the party's performance of these Terms and Conditions and which the party could not reasonably anticipate or overcome. In such force majeure situations, we shall have the right to postpone the fulfillment of the delivery without being obliged to pay damages to you. The circumstance that a subcontractor to SSE is affected by a circumstance which according to the above shall be considered as force majeure is also considered force majeure for SSE. We will notify you via email about the obstacle directly and how it affects the possibility of performing according to these Terms and Conditions.


Changes to these Terms and Conditions

We reserve the right to change the Terms and Conditions and the Digital Products found on our Website from time to time, but it is the version of these Terms and Conditions that is valid at the time of your purchase that applies to your order. Future changes to our Terms and Conditions will be announced on our Website and consequently apply in relation to any future purchase.


Compulsory Consumer Law

Consumers have special rights under compulsory consumer laws and regulations. SSE does not intend to limit or change these rights by these Terms and Conditions. We also do not intend to impose a greater responsibility on you than you have under compulsory consumer laws and regulations.


Customer support

If you have any questions or wish to contact us in withdrawal matters, we recommend you contact our customer service via our support form. If you submit your question regarding your purchase/order via email, we aim to answer you by replying to your email within 24 hours on weekdays and otherwise providing answers or information within 48 hours.


Language

The language used in documentation and in the contacts between us and you are English. The Website and these Terms and Conditions may be accessed in English.


Governing Law and Disputes

This Agreement shall be governed by the substantive law of Sweden. Any dispute, controversy or claim arising out of or in connection with this Agreement shall be settled by a Swedish court of general jurisdiction. Our ambition will however always be to resolve any dispute through mutual agreement between the parties.

If you are not satisfied with SSE's handling of your complaint, you as a consumer also have the right to submit the matter to the Swedish National Board for Consumer Disputes (Sw. Allmänna reklamationsnämnden) (“ARN”). ARN conducts impartial trials of disputes between consumers and companies. SSE always participates in such dispute settlement process. If you have a complaint about a Digital Product that you purchased from us online, you may use the European Commission's online platform for alternative dispute resolution (the "ODR platform") to try to resolve the issue out of court. The ODR platform can be accessed at https://ec.europa.eu/consumers/odr. You can also find more information and guidance regarding the ODR platform at the ODR platform’s website. 


Your personal data

We care about your privacy. Any personal data which, when applicable, you provide us when purchasing in Shop will be stored and processed electronically by us in accordance with our personal data policy. By using the Shop and/or ordering an item, you consent to our handling of your personal data in accordance with our privacy policy, please see SSE's privacy policy and SSE's cookie policy.
